Patent filing is fundamental for protecting your inventions and secure your exclusive rights over them. In Mexico, this process is regulated by the Mexican Institute of Industrial Property (IMPI), responsible processing, granting and managing patent rights. Before filing a patent application, it is advisable to perform a search. This search allows you to verify if the invention has already been patented both in Mexico and abroad and if there are similar patents that could prevent your application. Extensive searching helps minimize the risk of rejections and ensures that your invention meets the requirements for novelty and originality.
Once novelty of your invention is confirmed, the following step is to draft the patent application. Such applications must include:
Accuracy in drafting the application is crucial to ensure that the patent adequately covers your invention and to avoid problems during examination.
The application is filed at, either online or directly at its offices. You will have to pay a fee for submitting the application. Once submitted, IMPI will review the application to ensure that it meets the formal and substantive requirements.
IMPI will conduct a formal examination to verify that all documents are complete. Then, it will carry out a substantive examination to evaluate whether the invention meets the requirements of novelty, inventive level and industrial application. This examination will determine whether the invention is innovative and useful enough to be patented.
If the application passes the substantive examination, it is published in the Industrial Property Gazette. This publication allows third parties to file oppositions if they consider that the invention does not meet the patentability requirements or infringes their rights.
If no oppositions are filed or if they are resolved in favor of the applicant, IMPI grants the patent. Upon granting, the patent owner obtains exclusive rights to the invention for 20 years. It is important to keep your patent current by paying annual maintenance fees.
If you are willing to protect your invention in other countries, you may apply for an international patent through the Patent Cooperation Treaty (PCT). This treaty facilitates the patent application process in multiple countries, simplifying the global protection of your invention.
Registering a patent provides the applicant exclusive rights over its invention, preventing third parties from manufacturing, using or selling such invention without the owner’s permission. This allows the owner to take commercial advantage of such invention and avoid unfair competition.
